BidSnap - End-User License Agreement (EULA)

1. Agreement
This End-User License Agreement ("EULA") is a legal agreement between you ("User") and SquatchCraft LLC ("Company," "we," "us") governing your use of the BidSnap mobile application ("App"). By downloading, installing, or using BidSnap, you agree to be bound by the terms of this EULA. If you do not agree, do not use the App.
2. License Grant
We grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App on Apple devices that you own or control, strictly in accordance with this EULA and Apple's Usage Rules set forth in the App Store Terms of Service.
3. Restrictions
You may not:
- Copy, modify, distribute, sell, or lease any part of the App
- Reverse engineer, decompile, or disassemble the App
- Remove or alter any proprietary notices or labels on the App
- Use the App for any unlawful purpose or in violation of any applicable laws
- Use the App to transmit harmful, offensive, or illegal content
- Attempt to gain unauthorized access to the App's systems or networks
4. User Data and Responsibility
You are solely responsible for the accuracy and legality of the data you enter into BidSnap, including customer information, estimates, invoices, and financial records. BidSnap is a tool to assist your business operations and does not provide legal, financial, or tax advice. You are responsible for compliance with all applicable laws, including tax obligations and data protection regulations in your jurisdiction.
5. Third-Party Services
BidSnap may integrate with third-party services including but not limited to Stripe, Apple iCloud, Apple MapKit, and Cloudflare. Your use of these services is governed by their respective terms and conditions. We are not responsible for the availability, accuracy, or reliability of third-party services.
6. Disclaimer of Warranties
THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
7. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, SQUATCHCRAFT LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES ARISING FROM YOUR USE OF THE APP, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP.
8. Payment Processing
BidSnap facilitates the creation of estimates and invoices but does not directly process financial transactions. Payment processing is handled by third-party providers (Stripe, Venmo, Cash App, Zelle, PayPal, etc.) according to their own terms. We are not responsible for payment disputes, chargebacks, or issues arising from third-party payment services.
9. Intellectual Property
The App, including its design, code, graphics, and content, is the property of SquatchCraft LLC and is protected by copyright, trademark, and other intellectual property laws. This EULA does not grant you any rights to our trademarks, logos, or branding.
10. Termination
This EULA is effective until terminated. We may terminate your license at any time if you violate any terms of this agreement. Upon termination, you must cease all use of the App and delete all copies from your devices.
11. Governing Law
This EULA shall be governed by and construed in accordance with the laws of the State of Indiana, United States, without regard to its conflict of law principles.
12. Apple-Specific Terms
This EULA is between you and SquatchCraft LLC only, and not with Apple Inc. Apple has no obligation to furnish maintenance or support for the App. In the event of any failure of the App to conform to applicable warranties, you may notify Apple for a refund of the purchase price (if any); Apple has no other warranty obligation. Apple is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of this EULA and may enforce it against you.
13. Changes to This EULA
We reserve the right to modify this EULA at any time. Changes will be effective when posted. Continued use of the App after changes constitutes acceptance of the revised EULA.
